In this scenario, my options as a law enforcement officer include either to inform my department and the Internal Affairs Division that my partner brutally assaulted the suspect/offender or cover up for my partner by doing whatever is necessary to protect him from being held accountable for his actions. Each of these options has its own benefits and adverse consequences. Selecting the option of reporting my partner to the department for violating department rules and assaulting the offender has the benefit of ensuring that justice is done to the offender and my partner held accountable for his unethical actions and hence promoting public trust and confidence in the department.
However, the consequence of such an option is that it may expose the department to public and media ridicule, result in various civil lawsuits against the department, and possibly lose my job. On the other hand, electing to keep quiet about my partner's conductor lying in court about it would be beneficial in that it will save the department from costly lawsuits and protect both my partner and the department from public rage and uproar. However, its main consequence is that this will create a culture of tolerance of police brutality and impunity thus affecting the relations between the department and members of the community.
I would apply intentions by looking at what my partner intended to achieve by his actions and seemliness by looking at the extent to which his actions befitted the situation and hence if justified. Further, I would apply proportionality and practicality by weighing the partner's use of force against the offender's behavior or response during the incident to determine whether the force applied was justified.
The standard of objectivity as it relates to personal feelings applies is the standard for weighing and comparing one's actions against some established reasonable third party's actions and feelings. It is applied by asking the question of whether a reasonable third party in one’s position or situation would feel, act, or react in a particular manner.
