The American constitution does not expressly give rights to privacy. The bill of rights however gives a framework on the protection of various aspects of privacy. The 1st amendment provides privacy to beliefs, 2nd amendment offering the right to bear arms, 3rd amendment offers privacy to homes for use by soldiers, 4th amendment privacy against unreasonable searches, while the 5th amendment gives privacy against self-incrimination. The modern tort law also protects against the invasion of privacy in cases of intrusion, false light, public disclosure of private facts and appropriation. As such, the right to privacy of individuals in the United States has been protected through various amendments in the bill of rights. Despite the freedom to privacy as directed by the 1st amendment, the law criminalizes some activities that are under the influence of beliefs like abortion and homosexuality. The law states that it is illegal to compel people to perform such actions. However, the right to privacy has also contributed to the sodomy law enacted in 2003. The law provides that private sexual conduct is strengthened by liberty rights as long as there is consent.
The second amendment protects the rights of a state to have a regulated militia and gives people to bear arms. The bill, however, gives restrictions on the type of people that should own firearms. For instance mentally ill and felons do not enjoy this right because they are restricted from carrying dangerous weapons. The law, therefore, does not provide limitless ownership of guns but supports the rights to self-defense and against oppression.
The right to privacy has recently been invaded by freedom of expression. The most affected people are the politicians whose privacy has been invaded from all sides.
