This has been accompanied by a similar increase in the number of users of cannabis, as reflected in the associated increase of cannabis-related arrests. As such, proponents of legalization have argued that such a move would address the problem of increased arrests. Additionally, they also posit that the state, through the law, has no business in stopping individuals from using cannabis. As shall be seen, they argue that once informed of the consequences of cannabis, individuals should be left to make their own decisions concerning whether or not to use cannabis. However, this paper argues that cannabis use in Australia should not be legalized. The paper embarks on a rigorous defence for the purpose of the law in intervening in cannabis abuse. In addition, some of the arguments commonly presented for the defence of cannabis legalization are critically analyzed and rebuffed.
The Need for the Illegality of Marijuana
It is evident that cannabis use is a growing problem in Australia. According to the Australian Institute of Health and Welfare’s 2016 report, 35 percent of all people aged 14 years and above had used Marijuana in their lifetime (AIHW, 2019). Moreover, there are a large number of arrests related to the use of cannabis, with 48.8 percent of all the illicit drug arrests in 2017-2018 being for cannabis (AIHW, 2019).
